The Kansas Workers' Compensation Act was amended May 15, 2011. These changes have not been kind to workers. In order to have a valid claim, the work related accident must be the prevailing factor in causing your injury. In determining what constitutes the “prevailing factor”, in each case the administrative law judge will consider all relevant evidence. An injury is not compensable solely because it aggravates, accelerates, or exacerbates a pre-existing condition or renders a pre-existing condition symptomatic. There are additional changes in the new act including the manner notice is provided and calculation of work disability benefits.
