For those uninsured individuals, the Legislature has created the Kansas Automobile Assigned Claims Plan (KAACP) as required by K.S.A. 40-3116. The purpose of this plan is to provide personal injury protection benefits for those individuals who are injured in an automobile accident who do not have any PIP benefits available to them. If an individual owns a motor vehicle that is not insured, the person is not eligible for coverage under the plan. The benefits provided by the plan are set out in K.S.A. 40-3103 and include disability benefits, and survivor’s benefits.
