You must be a resident of the State of Kansas for sixty days prior to the filing of a divorce petition. If minor children are involved, the Kansas courts will usually not assume jurisdiction unless the child has lived here for a period of six months prior to the time the action is filed. Kansas courts have jurisdiction to make a fair division of property irrespective of how it is acquired or when received. In general, most courts attempt to return to each party property they have received by will or inheritance, or property they brought into the marriage to the extent such property is still exists. A premarital agreement may limit or alter the court's division of property.

Child support is calculated according to the most recent guidelines adopted by the Kansas Supreme Court which became effective April 1, 2012. These guidelines take into consideration several factors including gross income, age of the children, cost of health and dental insurance, work-related childcare costs, long-distance visitation, tax exemptions, special needs of the children, time spent with each parent as well as your overall financial condition. In addition, the court may make an adjustment if one of the parties paying support resides in another state where the cost of living is different or if the spouse paying support has another child that resides with him or her.

All child support or maintenance to be paid in Kansas is to be paid through the Kansas Payment Center or (877) 572-5722. The Kansas Payment Center is a state operated service which provides free accounting service for all support paid under the terms of a divorce decree or other order of child support or maintenance.
